An insurance company has sued Nintendo for $236,304, alleging that a faulty Nintendo DS AC adapter ignited a January, 2007 fire at a residence in Kentucky. According to the complaint, the home owner was compensated for "substantial" fire damage by the Liberty Mutual Fire Insurance Company. Liberty Mutual is attempting to recover its costs from Nintendo. In addition to the $236K, the company seeks interest and court costs. The suit, filed yesterday with the U.S. District Court for the Western District of Kentucky, notes that Nintendo previously conducted a product recall of DS units due to overheating issues. From the complaint:

Necroposting (post in a topic that hasn't had a reply in over a month, also called bumping) is allowed, as long as you say something that actually brings something new into the discussion. But you're new Sheik, so it's okay, don't worry about it. Anyway, I'm pretty sure that Nintendo has clearly said not to put the DS or accessories in intense cold or heat conditions. How, exactly, did they say it ignited? |

Apparently, it was a Japanese DS Lite that had already been recalled. If you are using a recalled system, you are using it at your own risk. Therefore, these people have no case. |
